开源精简指令集架构RISC-V凭借开放免费、可扩展定制、全场景适配的特性,已成为全球集成电路产业打破x86、ARM技术垄断的核心路径.据SHD Group数据,2024年全球RISC-V芯片市场规模达113亿美元,中国市场占比超25%;预计到2030年,全球市场规模将增长至927亿美元,年复合增长率高达47.9%.RISC-V已正式占据全球处理器市场25%的份额,成为第三大主流架构.然而,开源不等于知识产权无风险.本文基于全球产业数据,从RISC-V开源协议属性与知识产权边界出发,系统梳理其产业化过程中面临的五大类风险:专利侵权风险、开源许可证合规风险、IP与布图设计权属风险、国际标准治理地缘壁垒风险、产业专利碎片化风险.数据显示,ARM持有6,800余项已发布专利,x86专利墙超过45,000项,而RISC-V基金会层面专利仅约150项,专利防御能力严重不对等.本文从国际社区、产业联盟、市场企业、国家政策4个维度,构建多层次、全链条的知识产权治理体系,提出适配我国RISC-V产业发展与标准化建设的具体对策.

With the advantages of openness,free licensing,scalable customization and multi-scenario adaptability,the open-source reduced instruction set architecture RISC-V has become a core approach for the global integrated circuit industry to break the technological monopoly of x86 and ARM.According to SHD Group statistics,the global RISC-V chip market reached USD 11.3 billion in 2024,with China accounting for over 25%.It is projected to grow to USD 92.7 billion by 2030,registering a compound annual growth rate of 47.9%.RISC-V has captured 25%of the global processor market and evolved into the world's third mainstream architecture.Nevertheless,open-source does not equate to zero intellectual property risks.Based on global industrial statistics,this paper starts with the license attributes and IP boundary of open-source RISC-V,and systematically summarizes five major risks in industrialization:patent infringement risks,open-source license compliance risks,ownership risks of intellectual property and layout designs,geopolitical barriers in international standards governance,and industrial patent fragmentation risks.Data indicates that ARM holds more than 6,800 granted patents,while the x86 patent portfolio exceeds 45,000 patents.In contrast,the RISC-V International Foundation maintains merely around 150 patents,resulting in a severe imbalance in patent defense capabilities.From the perspectives of international communities,industrial alliances,market enterprises and national policies,this paper constructs a multi-level and full-chain intellectual property governance system,and puts forward targeted strategies for China's RISC-V industrial development and standardization construction.
