治理架构、国家诉求和机制响应:小岛国何以将全球气候问题诉诸国际司法OACHSSCD
Governance Architecture,State Claims,and Mechanism Responses:Why Small Island Developing States Seek International Climate Judiciary
小岛屿发展中国家积极推动将全球气候问题诉诸国际司法,已经成为全球气候治理领域一个引人注目的现象.《联合国气候变化框架公约》作为全球气候治理的主要渠道,已经为小岛国提供了制度性权力,使其在自身物质实力较弱的情况下仍然取得了较大的影响力.小岛国作为该主要渠道的受益者,为何还要在其之外诉诸司法路径?本文根据全球气候治理的架构特点、小岛国强烈的国家诉求、国际司法机制在应对气候问题上的独有特征三个方面,构建了"治理架构—国家诉求—机制响应"分析框架,从国际、行为体和机制层面分析该现象产生的原因.研究发现,当前全球气候治理"机制复合体"低等级性和高功能异质性的架构有利于新机制的产生,同时国际司法机制相比其他治理机制能够更好地响应小岛国加速气候治理进程、拓宽气候治理渠道这一核心诉求,因此小岛屿发展中国家将国际司法机制视为其解决全球气候问题的重要制度工具.
The active engagement of small island developing states(SIDS)in international climate judiciary has emerged as a notable phenomenon in global climate governance.However,the United Nations Framework Convention on Climate Change,as the primary channels of global climate governance,have already endowed SIDS with institutional power,enabling them to exert considerable influence despite their limited national power.Why have SIDS,as beneficiaries of the existing climate regime,nevertheless turned to judicial mechanism?This article develops an analytical framework of"governance architecture-state claims-mechanism responses"to examine the drivers of this phenomenon from international,actor,and institutional levels.The findings suggest that the low levels of hierarchy and high functional heterogeneity of the global climate governance regime complex provides space for regime creation.While international judiciary mechanism,compared with other mechanisms,is better able to respond to SIDS' claim of accelerating process and broadening channels for climate governance.Consequently,SIDS increasingly regard international climate judicial mechanisms as an important institutional tool.
