Government data power is a new form of power that emerges from government functions in data element governance.The government data power list system serves to delineate power boundaries,clarify the relationship between authority and responsibility,and shape the order of governance.Although central and local governments have conducted practical explorations in item identification,boundary delineation,allocation of powers and responsibilities,and procedural standardization,the construction of the government data power list system remains constrained by several factors,including difficulties in identifying the data collection power,disagreements over the classification of the authorized operation power,the absence of discretionary benchmarks for the regulatory enforcement power,and the opacity in exercising the algorithmic decision-making pow-er.Therefore,the construction and optimization of the government data power list system should adopt scenario-based identification and hierarchical classification as the principle to establish the fac-tual foundation for list formulation,pursue central-local coordination and the consistency between authority and responsibility as the orientation to optimize the configuration structure of government data power,prioritize scope expansion and procedural consolidation to promote the openness and transparency of implicit data power,leverage digitalized openness and multi-stakeholder supervision to build a closed-loop mechanism for list operation,and strengthen the rule of law and institutional innovation as the safeguard to enhance the sustained binding force of list implementation,thereby propelling the operation of government data power onto the track of the rule of law.
