Regulation(EU)2024/1735《净零工业法案》(Net-Zero Industry Act)是欧盟能源转型与供应链安全的战略性法案,对中国光伏产品出口欧盟地区造成了显著的影响.首先从限制第三国供应链依赖、引入"非价格标准"招标评估体系、设立"净零加速谷"机制 3 个方面剖析了欧盟对光伏产品进口监管政策的调整情况;然后从利润空间压缩、全球竞争力弱化、合规成本增加 3 个角度对欧盟政策调整后中国光伏企业对欧出口的潜在经营风险进行了分析,并提出了应对措施.分析结果表明:1)《净零工业法案》通过短期限制与长期替代的双轨措施限制欧盟光伏产业对第三国供应链的依赖,导致中国光伏企业的利润空间被压缩,并可能面临产能过剩与低价抛售的恶性循环.2)提出的"非价格标准"招标评估体系存在权重失衡的问题,导致中国光伏企业的全球竞争力弱化.3)"净零加速谷"机制给欧盟部分成员国在环境评估中带来了"自主调节"空间,导致中国光伏企业进入欧盟市场的合规成本显著增加.4)针对上述风险,提出搭建以光伏领域行业协会为中心的协同保障体系、实行跨国供应链碳披露协调路径、开发以区块链为核心的双轨制信息流通模式 3 大应对措施.可为中国光伏企业突破欧盟绿色贸易壁垒、维护其全球竞争力提供参考,也为全球光伏产业协同发展提供实践路径.

Regulation(EU)2024/1735,the Net-Zero Industry Act,is a strategic legislative measure by the EU aimed at energy transition and supply chain security,significantly impacting the export of Chinese PV products to the EU market.This paper first analyzes the EU's adjustments to import regulations policies for PV products from three perspectives:limiting reliance on third-country supply chains,introducing a"non-price criteria"bidding evaluation system,and establishing the"Net-Zero Acceleration Valleys(NAV)"mechanism.It then examines the potential operational risks for Chinese PV enterprises exporting to the EU under these policy adjustments from three angles:reduced profit margins,weakened global competitiveness,and increased compliance costs,proposing corresponding countermeasures.The analysis results show that:1)The Net-Zero Industry Act restricts the EU's PV industry's reliance on third-country supply chains through dual-track measures of short-term limitations and long-term substitutions,compressing profit margins for Chinese PV enterprises and potentially triggering a vicious cycle of overcapacity and low-price dumping.2)The proposed"non-price criteria"bidding evaluation system suffers from weight imbalances,undermining the global competitiveness of Chinese PV enterprises.3)The NAV mechanism has provided some EU member states with"self-regulation"space in environmental assessments,resulting in a significant increase in compliance costs for Chinese PV enterprises entering the EU market.4)In response to the above risks,three major measures are proposed:establishing a collaborative security system centered on PV industry associations,implementing a coordinated path for cross-border supply chain carbon disclosure,and developing a dual-track information circulation model with blockchain as the core.The analysis results can provide reference for Chinese PV enterprises to break through the EU's green trade barriers,maintain their global competitiveness,and also provide practical paths for the coordinated development of the global PV industry.
