论生态环境法典中信息共享机制的构造与实现OACHSSCD
On the Construction and Implementation of Information-Sharing Mechanisms in The Ecological and Environmental Code
《中华人民共和国生态环境法典》是我国全方位推进生态环境治理体系现代化的重要战略安排,需要进行针对性的分析.《中华人民共和国生态环境法典》总则编第二十三条创新性地规定了生态环境信息共享机制,是适应信息化、智能化要求而形成的"数智条款",对打破生态环境保护领域的"信息孤岛"、通过数据融合实现生态环境智能化治理具有重要的意义.法典其他分编对各领域、各层级的生态环境信息共享也作出了相应规定,共同形成了生态环境信息共享的体系化制度框架.其主要特征是:以各级政府为主要主体,包括横向部门间共享、纵向层级间共享、特定环境信息的部门间共享三个方面的内容.贯彻落实生态环境信息共享机制仍然存在一些体制机制的障碍,需要在贯彻落实的过程中,通过配套规制加以细化,在法典所确立的框架基础上进一步构建具体可操作的生态环境信息共享机制,明确"强制共享为原则、不共享为例外"的基本原则,健全生态环境监测数据共享平台、建立生态环境监测质量管理制度以及分级分类共享规则,强化生态环境信息平台建设和技术支撑机制,实现全部门、全领域、全过程的生态环境数据融合、信息交换和深度共享.
The Ecological and Environmental Code of The PRC represents a major strategic initiative for comprehensively advancing the modernization of ecological and environmental governance system in China and therefore requires targeted analysis.Article 23 of the General Provisions innovatively establishes an ecological and environmental information-sharing mechanism.As a"digital and intelligent clause"developed in response to the requirements of informatization and intelligent governance,it is of great significance for breaking down"information silos"in the field of ecological and environmental protection and promoting intelligent environmental governance through data integration.Other parts of The Ecological and Environmental Code of The PRC also contain provisions on ecological and environmental information sharing across different sectors and levels of governance,together forming a systematic institutional framework for ecological and environmental information sharing.Its main characteristics are as follows:governments at all levels serve as the principal actors,while the scope of information sharing includes three dimensions—horizontal sharing among departments,vertical sharing among different administrative levels,and interdepartmental sharing of specific environmental information.Nevertheless,significant institutional and operational obstacles remain in implementing the requirements of ecological and environmental information sharing mechanisms.These issues to be further addressed through supporting regulations during the implementation process.On the basis of the framework established by The Ecological and Environmental Code of The PRC,it is necessary to further develop a concrete and operable ecological and environmental information-sharing mechanism,clarify the principle that"mandatory sharing is the norm,while non-sharing is the exception,"improve environmental monitoring data-sharing platforms,establish a quality management system for ecological and environmental monitoring,and develop classified and hierarchical sharing rules.At the same time,greater efforts should be made to strengthen environmental information platforms and technical support mechanisms so as to achieve comprehensive data integration,information exchange,and in-depth sharing of ecological and environmental information across all departments,sectors,and stages of governance.
