刍议"气味"作为我国商标的接受可能性OACHSSCD

On the Acceptability of"Smell"as a Trademark in China

无论是2023 年国家知识产权局公布的《商标法修订草案(征求意见稿)》第4 条新增的"或者其他要素"表述,还是2025 年全国人民代表大会常务委员会公布的《商标法(修订草案)》第14 条增加的"动态标志等"表述,均体现出我国对非传统商标类型持开放的认定立场与趋势.然而,现阶段气味商标尚未纳入我国商标法的注册保护范围.究其原因,在于注册制度下气味商标难以满足商标认定的实质要件与形式要件.我国商标构成要素的沿革趋势,以及国际条约中有关气味商标的实践经验,可为其纳入注册保护范围提供论证依据.一方面,科技发展有助于气味商标的认定,在强化气味感知表达的同时亦在一定程度上化解了形式审查的难题;另一方面,气味商标作为经营者的劳动凝结与商誉积累的载体,通过获得显著性而完成商标的区分与识别功能,其符合实质要件,同时亦是商标私权财产受重视的体现.是故,我国可以此次《商标法》修订为契机,逐步对接国际条约相关条款,以期使气味商标在我国有作为商标入法的接受可能性.

The amendments in Article 4 of the"Draft Amendment to the Trademark Law(for Soliciting Opinions)"issued by China National Intellectual Property Administration in 2023,such as the addition of"or other elements,"and the amendments in Article 14 of the"Draft Amendment to the Trademark Law"issued by the Standing Committee of the National People's Congress in 2025,such as the inclusion of"dynamic symbols,"both reflect the open recognition model and trend for non-traditional trademark types.However,at this stage,olfactory or smell trademarks have not yet been incorporated into the registration criteria of China's Trademark Law.The underlying reason lies in the difficulty for smell trademarks,under the current registration system,to satisfy both the substantive and formal requirements for trademark recognition.Meanwhile,the evolving trend in China's trademark composition elements,together with practical experience concerning smell trademarks in international treaties,provides grounds for including smell trademarks within the scope of registration and protection.On the one hand,technological advancements greatly benefit the recognition of smell trademarks by strengthening the expression and perception of smells while also resolving difficulties in formal examination.On the other hand,as carriers of business operators'labor investment and accumulated goodwill,smell trademarks achieve the trademark functions of distinction and identification through the acquisition of distinctiveness.Therefore,China may take this revision of the Trademark Law as an opportunity to gradually align with relevant provisions of international treaties,aiming to make the legal recognition of smell trademarks in China possible.
