"枫桥经验"视域下工会劳动法律监督范式革新OACHSSCD
Paradigm Innovation of Trade Union Labor Law Supervision from the Perspective of the"Fengqiao Experience"
中国工会劳动法律监督是保障劳动者权益、构建和谐劳动关系的重要途径.工会劳动法律监督"一函两书"机制的要求和配套指引相对滞后,在制度运行中存在机制性缺陷与结构性矛盾.工会劳动法律监督理论经历了从"社会监督论"到"协同治理论",再到"工会枫桥论"的三重范式演进."一函两书"制度与"枫桥经验"的治理逻辑具有内在契合性,旨在实现工会的嵌入式监督治理,本质上是"枫桥经验"现代化转型中的劳动法治表达.工会劳动法律监督制度理论转向发展劳动领域的"枫桥经验",是结合实际提出的工会劳动法律监督制度的优化路径.本研究认为,应基于新时代"工会枫桥"的注重预防理念,发挥"一函两书"预防与监督的双重功能;借鉴"工会枫桥"中的多方参与经验,建立联动规范指引与标准;通过数字赋能工会劳动法律监督制度建设.
The trade union labor law supervision system in China is an important way to protect workers' rights and build harmonious labor relations.The"one letter and two documents"mechanism of trade union labor law supervision lacks supporting guidelines and has institutional defects and structural contradictions.The theory of trade union labor law supervision has undergone a triple paradigm evolution from"social supervision theory"to"collaborative governance theory"to"trade union Fengqiao theory".The"one letter and two documents"system is intrinsically compatible with the governance logic of"Fengqiao Experience",representing a labor law expression in the modern transformation of"Fengqiao Experience".Accordingly,based on the preventive concept of"trade union Fengqiao"in the new era,we should give full play to the dual functions of"one letter and two documents",draw on multi-party participation experience to establish linkage norms and standards,and strengthen the construction of trade union labor law supervision through digital empowerment.
