涉渔工程物理性污染的法理困境及破解路径研究OA

涉渔工程物理性污染是指涉渔工程在建设和运营过程中产生的噪声、冷热水、气体过饱和水体等,此类污染以能量的形式进入环境从而影响水生生物及其生境,对水生生物的生存和繁育造成一定威胁.本文以某水库泄洪导致的渔业水域污染事故为引入点,探讨了涉渔工程物理性污染的特性,梳理了我国相关监管制度并发现在涉渔工程中存在典型物理性污染判定难、法律规制不足、监督管理制度缺位等问题.在此基础上,提出了优化环境影响评价制度与应急预案制度、完善排污许可制度与环境监测制度、健全相关事故处置标准及法律责任等建议,以期为涉渔工程中物理性污染导致的水污染及水生生物破坏事件提出法律和制度改进建议,支持我国水生生物保护制度的完善.

Physical pollution of fishing-related projects refers to noise,hot and cold water,gas supersaturated water bodies and so on generated during the construction and operation of fishing-related projects.Such pollution enters the environment in the form of energy,thus affecting aquatic organisms and their habitats and posing a certain threat to the survival and breeding of aquatic organisms.Taking the fishery water pollution accident caused by flood discharge from a reservoir as the introduction point,this paper discusses the characteristics of physical pollution of fishing-related projects,and sorts out the problems existing in the relevant supervision system in China,such as the difficulty in judging typical physical pollution,insufficient legal regulation and the absence of supervision and management system.On this basis,this paper puts forward some suggestions,such as optimizing the environmental impact assessment system and emergency plan system,perfecting the pollutant discharge permit system and environmental monitoring system,and improving the relevant accident handling standards and legal responsibilities,in order to put forward suggestions for improving the law and system for water pollution and aquatic organism destruction caused by physical pollution in fishing-related projects and support the improvement of aquatic organism protection system in China.
