Regulatory Dilemmas in Prescription Drug Advertising in the Digital Era and Their Response Strategies
目的 探索数字时代背景下处方药广告的监管策略.方法 采用规范分析与文献研究相结合的方法,梳理我国处方药广告的新趋势、监管规则、实践困境,并提出有针对性的应对策略.结果 数字时代背景下,处方药广告呈现出圈层化精准传播,大数据行为对目标受众的行为预测与干预,广告与信息边界的消融等新趋势.执法实践凸显出法律边界模糊、平台责任虚化、技术监管手段滞后等关键问题.结论 建议进一步明晰法律边界,压实平台主体责任,引入技术赋能的智慧监管体系,培育社会共治的多元协同治理新范式,以实现保障公众用药安全与顺应技术发展的动态平衡.
Objective To explore regulatory strategies for prescription drug advertising in the digital era.Methods A combination method of normative analysis and literature research was adopted to sort out the new trends,regulatory rules,and practical dilemmas in prescription drug advertising in China,and targeted response strategies.Results In the digital era,the new trends in prescription drug advertising included targeted dissemination within specific social circles,big data-driven behavioral prediction and intervention,and the blurring of boundaries between advertising and information.Law enforcement practices have revealed key issues such as ambiguous legal boundaries,insufficient platform accountability,and lagging technological regulatory measures.Conclusion It is recommended to further clarify the legal boundaries,strengthen the accountability of platforms,introduce a technology-enabled smart regulatory system,and cultivate a new paradigm of diverse collaborative governance for social governance,in order to achieve a dynamic balance between ensuring public medication safety and the need to adapt to technological development.
