论教师惩戒纠纷的司法审查OACHSSCD
The Judicial Review of Disputes over Teacher Discipline
教师惩戒纠纷作为一种侵害受惩戒者人身权益的非文书性公法纠纷,本质上属于学校惩戒纠纷而非独立的纠纷类型,其在规范和实践层面涵盖了一般教育惩戒纠纷、暂时性约束措施纠纷、较重及严重教育惩戒纠纷等类型.此类纠纷的公法属性决定其应通过公法渠道解决,但由于教师惩戒相关规范长期匮乏,其被导入民事诉讼渠道并形成相应的民诉化救济模式.民诉化救济模式所依循的"公法关系—私法责任"思路在教育惩戒相关制度尚不完善的情况下发挥了应有的权利保护与救济功效,解决了教师惩戒纠纷中的民事赔偿问题,但混淆了公法侵权与民事侵权的界限,可能诱发教师惩戒权"软化"现象,并为相关主体规避公法责任提供了借口.相较而言,教师惩戒纠纷的司法审查具备充足的法理、规范及实践支撑,契合教育行政纠纷实质性化解的法治目标.为增强司法审查的实效性,应拓宽教师惩戒纠纷的司法审查范围,依据公益目的原则和比例原则对教师惩戒与相关行为进行界分,并将教师惩戒纠纷纳入行政赔偿范围.
Teacher disciplinary disputes,as non-documentary public law disputes that infringe upon the personal rights and interests of those being disciplined,essentially fall under school disciplinary disputes rather than being an independent category of disputes.They encompass various types at the normative and practical levels,including general educational disciplinary disputes,disputes over temporary restraint measures,and disputes over relatively severe and serious educational disciplinary actions.The public law nature of teacher disciplinary disputes determines that they should be resolved through public law channels.However,due to the long-term lack of relevant norms on teacher discipline,such disputes have been channeled into civil litigation and formed corresponding civil litigation-based relief models.The"public law relationship—private law liability"approach followed by the civil litigation relief model has played its due role in rights protection and relief when the relevant systems of educational discipline are not yet perfect,and has solved the civil compensation problem in teacher disciplinary disputes.However,it has confused the boundary between public law infringement and civil infringement,potentially inducing the"softening"of teacher disciplinary rights and providing an excuse for the relevant subjects to evade public law responsibilities.In comparison,the judicial review of teacher discipline disputes has sufficient legal theory,norms and practical support,and is more in line with the legal goal of substantive resolution of educational administrative disputes.To enhance its effectiveness,the scope of judicial review of teacher discipline disputes should be broadened.Based on the public interest purpose and the principle of proportionality,the distinction between teacher discipline and related behaviors should be made,and the teacher disciplinary disputes should be included in the scope of administrative compensation.
