规划环境影响评价的制度反思与规范因应OACHSSCD

The planning environmental impact assessment system plays an indispensable role in enhancing the scientific nature of planning and preventing environmental risks.The compensation claim case in which Lujiazui Company purchased"contaminated land"reveals that,in the field of comprehensive planning,China's current planning environmental impact assessment system suffers from problems such as the narrow scope of objects,insufficient enforceability,and imperfect public participation.Consequently,at the practical level,even when administrative agencies conduct planning environmental impact assessments in accordance with the law,it remains difficult to prevent the occurrence of environmental damage.In view of this,the improvement of the planning environmental impact assessment system urgently requires expanding the scope of objects of planning environmental impact assessment,establishing the independent legal status of planning environmental impact assessment documents for comprehensive planning and standardizing their review procedures,and improving the public participation mechanism for planning environmental impact assessment,so as to effectively prevent and control environmental risks at the early stage of planning decision-making.
