司法建议赋能社会治理现代化的多重逻辑、实践困境及路径选择OA

As a judicial mechanism with Chinese characteristics,judicial recommendations have important theoreti-cal and practical significance for promoting the modernization of social governance.In the context of social gover-nance modernization,this paper systematically examines the points of convergence between judicial recommenda-tions and the modernization of social governance from both theoretical and practical perspectives.At the same time,it highlights the functional role of judicial recommendations and focuses on their current application in the practice of social governance modernization,accurately identifying the objective problems that constrain judicial recommen-dations at three levels:scale,policy,and effectiveness.Finally,to better realize the function and effects of judicial recommendations in promoting the modernization of social governance,it is necessary to build a"rule-of-law guar-antee"for social governance from three aspects:expanding application domains,strengthening policy guidance,and enhancing coordination and linkage.
