全球反兴奋剂治理的挑战与变革:迈向体育善治的路径探索OA

In recent years,there has been a global consensus on promoting anti-doping governance.The concept of good governance in sports,as an advanced governance philosophy,has pointed out a new direction for global anti-doping efforts.Using methods such as literature review and logical analysis,this study examines the challenges in global anti-doping governance and explores pathways based on the principles of good governance in sports.The research finds that the World Anti-Doping Agency(WADA)faces numerous obstacles in coordinating with various organizations during the governance process.The World Anti-Doping Code also has limitations including practical loopholes and lag.In particular,the extraterritorial jurisdiction measures adopted by the United States have disrupt-ed the sovereignty balance and rule unification of the existing governance system.Based on these findings,the following exploratory paths are proposed:1)Guiding reforms with the principles of good governance,optimizing liability determination in the Code by incor-porating the principle of fault-based liability to enhance fairness.2)Reforming WADA's role,improve its independence,democratiza-tion and transparency,and strengthen its comprehensive coordination capacity;3)Addressing the challenges of extraterritorial juris-diction,safeguard national sovereignty and the stability of the governance system,while preventing the loss of subject status.
