人工智能时代法学研究的范式重构与转型应对OA
Paradigm reconstruction and response of legal research in the era of artificial intelligence:On the adaptation of legal education
人工智能时代的法学研究正经历深刻变革.人工智能对法学研究产生多维影响,对法学研究范式的变革、新框架的构建、法学教育的因应路径都提出了新的要求.人工智能法学是人工智能时代法学研究的新门类,作为新兴交叉学科,具有独立方法论和理论体系,与传统部门法学在研究思维、数据角色、价值取向、研究方法和视角等方面差异显著.法学研究范式正从经验分析转向数据驱动、从价值理性转向工具理性、从单一研究转向多维研究.法学研究范式转型背景下,法学教育需重构智能化理念、创新知识与课程体系、创新教育模式、转型智能化师资、建立智能化评价体系,以培养具备技术理解、价值判断和国际视野的复合型法律人才,应对人工智能带来的挑战与机遇.
The rapid advancement of artificial intelligence(AI)is fundamentally reshaping the knowledge structure and methodological foundations of legal research.Exploring fundamental transformations in research paradigms,this study aims at systematically examining the profound and multifaceted impacts of AI on legal scholarship,constructing innovative frameworks to tackle emerging technological challenges,and examining adaptive pathways for reshaping legal education.The study argues that AI law,as an emerging interdisciplinary field,has developed a relatively independent methodological and theoretical system,differing significantly from traditional doctrinal legal studies in terms of research ideas,the role of data,value orientation,methodologies,and analytical perspectives.The paradigm of law research is transitioning from empirical analysis to data-driven approaches,from value rationality to instrumental rationality,and from single dimensional inquiry to multidimensional integration.Against this backdrop,legal education must reconstruct its intellectual orientation toward intelligence,reform knowledge and curriculum systems,innovate pedagogical models,transform faculty structures,and establish diversified intelligent evaluation mechanisms.These efforts aim to cultivate interdisciplinary legal professionals equipped with technological literacy,normative judgment,and a global perspective,thereby effectively responding to the opportunities and challenges brought by AI.
