教师AI胜任力的软法之治与制度转化OACHSSCD
Soft Law Governance and Institutional Transformation of Teachers' AI Competence
人工智能的加速应用正在深刻重塑教育治理结构,同时也暴露出教师AI胜任力建设中的制度滞后与规范缺口.教师AI胜任力已从技术性能力要求上升为关涉教育质量、教育公平与权利保障的制度性议题,需要借助稳定的规范体系予以支撑.联合国教科文组织发布的《教师人工智能能力框架》提出以价值原则、技术素养与教学方法共同构成的能力模型,为教师AI胜任力的内容结构、进阶机制与制度契合提供系统性参照.作为教育领域的重要软法文本,《教师人工智能能力框架》以倡导性规范、结构化能力体系与可参照的政策工具推动教师AI胜任力在全球范围内扩散与本土化吸纳,并呈现由软法向制度规则渐进转化的趋势.其制度化逻辑一方面以受教育权保障为价值基础,通过促进教师能力提升回应数字时代教育权的新要求,另一方面依托政策吸纳、行业标准、资格体系与立法嵌入等机制,为能力框架的制度转化提供规范路径,推动教师AI胜任力从倡议性规范迈向制度化责任.
The accelerated adoption of artificial intelligence is profoundly reshaping the structure of education governance,while simultaneously exposing institutional lag and normative gaps in the development of teachers' AI competency.Teachers' AI competency has expanded beyond a technical skill requirement and has become an institutional issue concerning education quality,educational equity,and the protection of rights,thereby necessitating support from a stable normative framework.UNESCO's AI Competency Framework for Teachers(2024)proposes a competency model integrating value principles,technological literacy,and pedagogical methods,offering a systematic reference for the content dimensions,progression pathways,and institutional alignment of teachers' AI competency.As a major soft-law instrument in the field of education,the Framework promotes the global diffusion and localized adoption of teachers' AI competency through its advocacy-oriented norms,structured competency architecture,and policy-relevant tools,while also showing signs of gradual transformation from soft law to institutionalized rules.Its institutionalization logic is grounded,on the one hand,in the protection of the right to education,addressing new demands of the digital age by enhancing teachers' professional capabilities;on the other hand,it relies on mechanisms such as policy incorporation,sectoral standards,qualification systems,and legislative embedding to provide normative pathways for the Framework's institutional transformation,advancing teachers' AI competency from aspirational norms toward institutionalized obligations.
