Reflection on the Presetting Power of Administrative Regulations for Reconsideration
行政法规的复议前置设定权源于《行政复议法》第 23 条第 1 款第 5 项的授予.复议前置在形式上受行政诉讼制度所规束,对当事人的获得实体裁判权以及法院实体审理工作的启动产生直接影响,故属司法制度的范畴,进而被纳入法律绝对保留事项.基于此,原则上不得在法律之规定有所空白时授权其他下位法规范设定复议前置情形.这意味着行政法规的复议前置设定权存在合法性瑕疵.从设定复议前置情形的规范实践来看,与既有法律设定复议前置的情形相比,既有行政法规设定复议前置的情形大多有悖于《行政复议法》内含的复议前置设定标准.而从宏观效果来看,在当前行政复议机关的承载能力和实质解纷能力下,保留行政法规的复议前置设定权虽可在形式上增加复议案件数量,但对实现行政复议的主渠道目标并无实质助益.行政法规的复议前置设定权不宜继续保留.
The presetting power of administrative regulations for reconsideration originates from the grant of item 5,Paragraph 1,Article 23 of the Administrative Review Law.Preposition for reconsideration is regulated by the administrative litigation system in form,which has a direct impact on the parties'obtaining the substan-tive judgment power and the start of the court's substantive trial work.Therefore,it belongs to the category of ju-dicial system and is further included in the absolute reservation of law.Based on this,in principle,when there is a gap in the law,other lower law norms should not be authorized to set up the precondition for reconsidera-tion.This means that the presetting power of administrative regulations for reconsideration has legitimacy de-fects.From the perspective of the normative practice of setting the precondition for reconsideration,compared with the situation of setting the precondition for reconsideration in the existing law,the situation of setting the precondition for reconsideration in the existing administrative regulations is mostly contrary to the standard of setting the precondition for reconsideration contained in the Administrative Review Law.From the perspective of macro effect,under the current carrying capacity and substantive dispute resolution capacity of administrative reconsideration organs,although retaining the presetting right of administrative regulations for reconsideration can increase the number of reconsideration cases in form,it is not substantively helpful to realize the main channel goal of administrative reconsideration.Therefore,the presettingpower of administrative regulations for reconsideration should not be retained.
