为实现《巴黎协定》目标,各国的气候治理行动与现行国际投资法体系的冲突日益加剧,尤其体现在"间接征收"的认定上.由于国际法对于合法监管与应予补偿的间接征收之间界限模糊,相关投资仲裁实践呈现出裁决分裂、标准混乱的困境,严重损害了法律的确定性.此种困境的根源,在于"警察权力"与"效果标准"学说之间根深蒂固的法理冲突,而气候治理颠覆性的转型需求则急剧放大了这一矛盾,使得传统投资法框架与全球气候治理议程之间产生了"系统性不兼容".为破解此困境,出路在于系统性变革:协定层面应超越"碎片化"修补,通过澄清核心保护条款与设计例外条款来捍卫气候政策空间;司法层面,应构建一个结构化的四步分析框架为仲裁庭提供更清晰的裁判思路.中国也应在"人类命运共同体"理念的指引下,推进国际条约的修订谈判和司法适用,并在国际合作中积极探索和贡献能够平衡各方利益的中国方案.

Efforts to achieve the objectives of the Paris Agreement have intensified tensions between na-tional climate governance measures and the existing international investment law regime,particularly in relation to the determination of"indirect expropriation".Because international law has not clearly defined the boundary between legitimate regulatory action and compensa-ble indirect expropriation,investment arbitration practice has produced fragmented decisions and incon-sistent legal standards,thereby undermining legal certainty.This dilemma largely stems from the long-standing jurisprudential conflict between the"police powers"doctrine and the"sole effects"doctrine.The transformative nature of climate governance has further amplified this tension,revealing a form of"systemic incompatibility"between the traditional investment law framework and the demands of global climate governance.Addressing this challenge requires structural reform.At the treaty level,reform should move beyond piecemeal amendments by clarifying the substantive standards of key investment pro-tection clauses and incorporating well-designed exception provisions to preserve regulatory space for cli-mate policies.At the adjudicative level,a structured four-step analytical framework should be developed to provide clearer guidance for arbitral tribunals.Guided by the vision of building"a Community with a Shared Future for Mankind,"China should also play a proactive role in promoting treaty reform and sha-ping judicial practice,while exploring and contributing a"Chinese solution"that balances the interests of investors,host states,and the global community.
