Analysis of the Impact of Labor Rights Protection for Flexible Workers in New Business Models
在数字经济快速发展的背景下,新业态灵活就业群体规模持续扩大,已成为我国劳动力市场的重要组成部分.然而,平台算法主导的劳动控制模式在提升效率的同时,也对劳动者的权益保障构成严峻挑战.本文基于劳动关系系统理论,构建"平台—政府—从业者—工会"四维分析框架,运用结构方程模型对新业态劳动者中的典型群体——外卖配送员的劳动权益保障影响机制进行实证分析.研究发现:平台算法控制通过削弱工作自主性与激发员工算法反抗两条间接路径负向影响劳动权益;工作自主性对劳动权益保障具有显著正向作用(β=0.671),而算法反抗则显著抑制权益实现(β=-0.306);政府政策保障与工会支持虽未直接提升劳动权益,但分别通过增强算法反抗意识(β=0.172)和提升工作自主性(β=0.894)发挥间接赋能作用.研究揭示了制度供给与治理效能之间的"政策悬浮"困境及工会职能的技术性受限机制.据此,本文提出构建算法共治委员会、推行"类雇员"制度、实施社保积分制与职业伤害即时认定等协同治理路径,以破解新业态劳动者权益保障的结构性难题,为完善数字时代劳动治理体系提供理论支持与政策启示.
Against the backdrop of rapid digital economy development,the continuously expanding group of flexible workers in new business models has become an important component of the labor market.However,while labor control model dominated by the platform algorithm improves efficiency,it also poses severe challenges to the labor rights protection.This paper constructs a four-subject analytical framework of"platform-government-workers-labor union"based on the labor relations system theory,and uses structural equation model to empirically analyze the influencing mechanisms of labor rights protection for the delivery riders,a typical group of workers in new business models.The findings indicate that platform algorithm control negatively impacts on labor rights through two intermediary paths:weakening work autonomy and triggering labors' algorithm resistance.Work autonomy has a significant positive effect on the labor rights protection(β=0.671),while algorithm resistance significantly inhibits the realization of rights(β=-0.306).Although government policy safeguard and labor union support do not directly improve labor rights,they play an indirect empowerment role by enhancing algorithm resistance awareness(β=0.172)and improving work autonomy(β=0.894),respectively.The study reveals"institutional suspension"dilemma between institutional supply and governance effectiveness,as well as the technical restriction mechanism of labor union functions.To address these challenges,the study recommends collaborative governance paths such as establishing algorithmic co-governance committee,introducing a"quasi-employee"system,adopting a social security points system and immediate identification of occupational injuries,so as to solve the structural problems in labor rights protection in new business models and provide theoretical support and policy implications for improving the labor governance system in the digital era.
