无工程量项目的不平衡报价,目前国家法律法规没有相关规定.文章依托某电站施工迹地恢复工程,分析不平衡报价的法律效力,从有效说、无效说以及相对有效说等 3 种法律效力分析各自依据以及来源,提出无工程量项目的不平衡报价处理方法、计算原则,分析探讨不同处理方法的优缺点,提出相应建议.
The unbalanced quotation of projects without engineering quantity is currently not regulated by relevant national laws and regulations.This paper relies on a construction site restoration project of a power station to analyze the legal effectiveness of unbalanced pricing.It analyzes the basis and sources of three legal effectiveness theories:effective theory,invalid theory,and relatively effective theory.It proposes methods and calculation principles for handling unbalanced pricing of projects without engineering quantity,analyzes and discusses the advantages and disadvantages of different handling methods,and puts forward corresponding suggestions.
