Objective To analyze the current status of patent applications for traditional Chinese medicine(TCM)inventions in Henan Province in the past decade,and to identify the problems in patent protection for TCM inventions.Methods The Patentics database was used to retrieve the patents for TCM inventions applied by Henan Province in the past decade.The patents for TCM inventions were compared and analyzed from aspects such as patent type,annual application volume,comparison of data in the same period,distribution of patent application volume in 18 cities,and types of applicants.The application quality of patents for TCM inventions was described from aspects such as authorization volume,legal status,global layout,and citation status.Results In the past decade,the overall patent applications number for TCM inventions was 9 851,which showed a overall downward trend in Henan Province.Among the 18 cities under its jurisdiction,Zhengzhou City has a much higher number of patent applications(4 756 cases)than other cities;the patents were mostly applied for in the name of individuals(4 940 cases).The overall number of patent authorizations was 1 483,which showed a fluctuating downward trend,with an annual authorization volume of fewer than 230 cases and an average annual authorization rate of 18.55%.The legal status was mainly"withdrawn"(46.75%)and"rejected"(34.75%),with only 8.07%of valid patents and very few overseas patent applications.The patents of Henan University of Traditional Chinese Medicine have been highly cited,and their functional research mainly focused on"improving vision""drying dampness and resolving phlegm""diuresis and promoting diuresis""soothing the liver and regulating Qi",etc.Conclusion In the past decade,the enthusiasm for patent applications for TCM inventions in Henan Province has been relatively high,but the quality of patents needs to be improved.Government departments should do a good job in promoting patent policies and building supply and demand platforms,guide the cultivation of high-value patents guided by market application,and pay attention to the balanced development of TCM patents in various cities.
