生态环境损害救济制度陆海统筹的法典融入路径OA
Integrating land-sea coordination into the codification of the ecological and environ-mental damage relief regime
"陆海统筹"作为引领中国经济发展和生态文明建设的全局性战略部署,要求对"陆海分割""河海分治"的传统管理模式进行制度性变革.陆海生态系统的整体性、环境要素的流动性以及污染传输的链式效应,蕴含着"治海必先治河,治河必先治陆"的治理逻辑,决定了陆海环境治理必须实现从"末端应对"向"全过程控制"、从"要素分割"到"系统整合"的转变,塑造与陆海生态系统结构和功能完整性相适应的治理格局.生态环境法典是推进生态文明建设、构建"从山顶到海洋的保护治理大格局"的核心载体与制度框架,陆域和海洋环境均应作为其规范对象,以回应"陆海统筹"的国家战略.陆海环境损害救济规范须融入生态环境法典,建立陆海一体化的生态环境法典规范体系,以弥合目前环境损害救济制度陆海分立的运行结构,推动形成从山顶到海洋的生态环境保护制度体系,实现陆海环境协同治理.一是在法典中为生态环境损害赔偿制度在陆海环境损害一体化救济体系中的适用提供法律依据,明确赔偿磋商的法律性质;二是在法典中以专门性条款弥补生态环境损害赔偿制度的不足,实现赔偿磋商与行政执法、赔偿诉讼的分流衔接,发挥陆海环境行政公益诉讼的督促作用,确保行政机关切实履行维护环境公益的职责;三是在法典中厘清生态环境损害赔偿诉讼的制度定位,理顺其与环境民事公益诉讼的适用关系,统合诉讼主体资格,促进陆海环境公益保护的社会参与和监督,构建陆海一体化适用的环境民事公益诉讼制度,化解当下陆海环境损害诉讼制度双轨并行的困境.
As an overarching strategic deployment guiding China's economic development and ecological civilization construction,"land-sea coordination"necessitates institutional reform of the traditional management model characterized by"land-sea segmenta-tion"and"river-sea separate governance."The integrity of land-sea ecosystems,the fluidity of environmental elements,and the chain effects of pollution transmission embody the governance logic that"to govern the sea,one must first govern the rivers;to govern the riv-ers,one must first govern the land."This logic dictates that land-sea environmental governance must shift from an"end-of-pipe re-sponse"to a"whole-process control"and from"elemental segmentation"to"systematic integration,"thereby shaping a governance framework compatible with the structural and functional integrity of land-sea ecosystems.The Ecological and Environmental Code(here-inafter referred to as the Code)serves as the core vehicle and institutional framework for advancing ecological civilization and construct-ing a grand governance pattern from mountaintops to oceans.Both terrestrial and marine environments should be its regulatory objects,in response to China's national strategy of"land-sea coordination."Regulations concerning land-sea environmental damage relief must be integrated into the Code to establish a unified codification system.This aims to bridge the currently fragmented operational structure of ecological and environmental damage relief systems across land and sea,promote the formation of an integrated ecological and envi-ronmental protection institutional system from mountaintops to oceans,and achieve synergistic governance of land-sea environments.First,the Code should provide a legal basis for applying the ecological and environmental damage compensation system within a unified land-sea damage relief framework,clarifying the legal nature of compensation consultation.Second,the Code should incorporate special-ized provisions to address the shortcomings of the ecological and environmental damage compensation system,enabling the diversion and linkage between compensation consultation,administrative law enforcement,and compensation litigation,while leveraging the su-pervisory role of land-sea environmental administrative public-interest litigation to ensure administrative authorities diligently fulfill their duties to protect environmental public interests.Third,the Code should clarify the institutional positioning of ecological and envi-ronmental damage compensation litigation,rationalize its relationship with environmental civil public-interest litigation,unify the quali-fications for litigation subjects,foster social participation and supervision in protecting land-sea environmental public interests,and con-struct a unified environmental civil public-interest litigation system applicable across land and sea,thereby resolving the current dilem-ma of parallel dual-track litigation systems for land-sea environmental damage.
