欧盟、美国与中国印染助剂监管机制的比较法研究OA
Comparative law study on the regulatory mechanisms of printing and dyeing auxiliaries in European Union,the United States and China
印染助剂作为关键化学品,在纺织工业生产过程中发挥着重要作用.各国对于纺织化学品的监管机制侧重点不同:欧盟结合REACH法规、CMR限制与SVHC清单,强调事前预防与替代限制;美国通过出台《有毒物质控制法》与NPDES许可,将重点放在有毒物质控制与污染源头治理上;中国对于纺织化学品的治理结构可分为化学品安全生产、化学品安全管理与化学品环境保护3个部分,以此构建化学品登记与环境监管并重的框架.比较法研究吸收欧盟与美国的制度经验,可使未来我国的化学品监管体系更好地实现法治化、科学化与国际化平衡.
Printing and dyeing auxiliaries,as key chemicals,play a significant role in the production pro-cess of the textile industry.The regulatory mechanisms for textile chemicals vary among countries:The EU combines the REACH regulation,CMR restrictions,and the SVHC list,emphasizing pre-emptive prevention and alternative restrictions.The United States has focused on the control of toxic substances and the treat-ment of pollution sources by introducing the Toxic Substances Control Act and NPDES licensing.China's gov-ernance structure for textile chemicals can be divided into three parts:chemical safety production,chemical safety management,and chemical environmental protection,thereby establishing a framework that attaches equal importance to chemical registration and environmental supervision.The study of comparative law,which absorbs the institutional experiences of the European Union and the United States,can enable China's future chemical regulatory system to better achieve a balance among legalization,scientification and internationaliza-tion.
