教育算法主体概念建构下的分层责任归属机制研究OA
Research on Stratified Responsibility Attribution Mechanisms under the Conceptual Construction of Educational Algorithmic Agency
随着人工智能深度介入教育活动,其在内容生成、学习分析与教学决策等环节中逐渐形成对教育过程的实质性影响.现行教育法理论以法人和自然人为主体,难以涵盖人工智能与开发者、运营者、使用者之间形成的多主体交互结构,导致算法介入教学实践时的责任认定缺乏清晰的法律依据.本文提出"教育算法主体"概念,依据算法在教学中的功能角色、参与深度与风险特征,将教育算法主体划分为被动执行型、引导反馈型与深度干预型三类,并在此基础上构建分层责任归属机制:被动执行型算法以使用者责任为核心;引导反馈型算法通过改造过错推定原则并引入协同证明机制,实现多主体责任配置;深度干预型算法则适用严格责任原则,以应对其可能引发的系统性风险.结合制度化治理路径,本文进一步构建了分层责任归属与风险治理相衔接的规范框架,为教育数字化背景下人工智能治理及"人工智能+教育"法治体系的完善提供参考.
As artificial intelligence(AI)becomes increasingly integrated into educational activities,it has developed a substan-tive influence over key processes such as content generation,learning analytics,and instructional decision-making.Existing theories of education law,which are centered on natural persons and legal persons,are insufficient to capture the multi-actor interactive struc-ture formed among AI systems,developers,operators,and users.This inadequacy results in a lack of clear legal grounds for attributing responsibility when algorithms intervene in teaching practices.This study proposes the concept of the"educational algorithmic sub-ject."Based on the algorithm's functional role in teaching,degree of participation,and risk characteristics,educational algorithmic subjects are classified into three types:passive execution,guidance-and-feedback,and deep intervention.On this basis,a stratified responsibility attribution mechanism is constructed:passive execution algorithms place primary responsibility on users;guidance-and-feedback algorithms achieve multi-actor responsibility allocation through a modified presumption of fault principle combined with a collaborative mechanism of proving;and deep-intervention algorithms are subject to strict liability to address the systemic risks they may generate.By integrating tiered responsibility attribution with institutionalized governance pathways,this study further develops a normative framework that links responsibility allocation with risk governance,providing a reference for AI governance in education and for improving the legal framework of"AI+education"in the context of educational digitalization.
