系统论法学视角下流域生态环境协同立法的功能定位与制度进路OACHSSCD
Functional Orientation and Institutional Pathways of Collaborative Legislation on River-Basin Ecological Environment from the Perspective of Systems Theory of Law
随着国家区域协调发展战略的深入推进,流域生态环境协同立法成为破解流域生态治理碎片化、实现跨行政区划协同治理的关键制度创新.我国流域生态环境立法实践中存在立法主体协同尚未实现全面覆盖、立法内容协同深度不足、立法协同保障机制不完善等问题.系统论法学以其"封闭运作/认知开放"的辩证逻辑,为流域生态环境协同立法提供了理论基础和方法论指引.法律系统与流域生态环境系统之间存在本质性差异,但可以通过"结构耦合"实现相互沟通与协调,并借此重构流域生态环境协同立法、整合协调多元利益、稳定规范性预期、促进空间正义为核心的功能定位.在制度层面,明确流域协同立法中多元立法主体的地位,针对省内跨市级协同立法、省际协同立法及不同省份内跨市级协同立法等不同类型,设计差异化的流域生态环境协同立法机制.在立法内容上,重点围绕生态保护补偿、环境标准与数据共享、法律责任等关键议题,形成协调一致的规则框架.同时,基于"反身性"与"程序悖论"理论,构建纵向衔接、横向联动的立法质量保障机制,为流域生态环境协同治理提供系统性与规范化的制度支撑,从而推动流域生态环境协同立法进程,化解流域生态环境协同立法实践中面临的困境.
As China's regional coordinated development strategy continues to deepen,collaborative legislation on the river-basin ecological environment has become a pivotal institutional response to the persistent fragmentation of basin ecological governance and the pressing need for genuinely inter-jurisdictional collaborative governance.However,current legislative practice still faces significant challenges,including incomplete collaboration among legislative actors,limited depth of coordination in legislative content,and inadequacies in the mechanisms necessary to sustain legislative collaboration.Drawing on the systems theory of law,characterized by the dialectical logic of operational closure and cognitive openness,this study provides a theoretical and methodological framework for improving collaborative legislation on the river-basin ecological environment.Although the legal system and the river-basin ecological environmental system are fundamentally different in nature,effective interaction and coordination can nevertheless be achieved through structural coupling.On this basis,the functional orientation of collaborative legislation on the river-basin ecological environment can be reconstructed to focus on integrating multiple interests,stabilizing normative expectations,and advancing spatial justice.At the institutional level,it is essential to clarify the roles and responsibilities of diverse legislative actors and to develop differentiated collaborative legislative mechanisms suited to varying governance contexts,including intra-provincial cross-prefectural collaboration,inter-provincial collaboration,and cross-prefectural collaboration across different provinces.In terms of legislative substance,particular attention should be paid to key domains such as ecological compensation,environmental standards and data sharing,and legal liability,with a view to building a coherent and mutually reinforcing normative framework.Furthermore,informed by the theories of reflexivity and procedural paradox,a legislative quality assurance mechanism featuring vertical coordination and horizontal linkage should be established to provide systematic,proceduralized,and standardized institutional support for collaborative river-basin ecological governance.In this way,the advancement of collaborative legislation on the river-basin ecological environment can be effectively promoted,and the practical dilemmas presently encountered in the collaborative legislation on the river-basin ecological environment can be progressively mitigated and resolved.
