新污染物治理的逻辑理路与法典构造OA

Logical pathways and codification structure for the management of emerging contaminants

新污染物治理是新时代中国生态文明建设所赋予的全新使命与前沿议题.当前,中国新污染物治理虽有一定立法基础,但却存在规制理念滞后、立法供给不足等突出问题,难以满足本领域协同治理与环境风险管控的现实需求.检视过往中国环境污染防治实践可以发现,其大体是依循"还原主义"思维施行分散治理模式,这显然与新污染物综合性、复杂性、协同性的治理需求不相匹配.鉴于此,要实现中国新污染物治理工作的稳健、有序发展,就须跳出传统意义上分散、静态、被动、末端治理的逻辑理路,转而构筑起一个适合中国国情的新污染物协同治理和环境风险管控体系.建立新污染物协同治理和环境风险管控体系的关键在于立法;对此,中国学界大体提供了专项立法模式、环境单行法分散规定模式、法典化模式等3种立法规制路径.相较于前两种立法选项而言,法典化模式是符合中国环境法治发展现状最为适恰的选择.因而,在生态环境法典已被提上立法议程的时代背景下,宜借此契机在法典编纂中对新污染物治理议题作出统筹规定与系统安排.未来,中国新污染物治理应以保障生态环境安全与公众健康安全为价值取向,以整体系统观为根本遵循,以协同治理为基本方式,以环境风险管控为核心内容.循此为进,基于"适度法典化"的立法需求,中国应在生态环境法典中确立风险预防原则以凸显安全价值,设置"新污染物治理和风险管控"专章以满足实践之需,推动相关概念及制度向新污染物治理领域延伸以实现体系融贯.

The management of emerging contaminants represents a new mission and a cutting-edge issue mandated by China's ecologi‐cal civilization construction in the new era.At present,although China possesses a certain legislative foundation for managing emerging contaminants,prominent problems remain,such as lagging regulatory concepts and insufficient legislative supply.Consequently,it is difficult to meet the practical demands for collaborative management and environmental risk control in this field.An examination of past environmental pollution prevention and control practices in China reveals a general adherence to"reductionist"thinking when im‐plementing a decentralized management model.This approach is clearly incompatible with the comprehensive,complex,and collabora‐tive management requirements of emerging contaminants.In view of this,to achieve the steady and orderly development of emerging contaminant management in China,it is necessary to break away from the traditional logic of decentralized,static,passive,and end-of-pipe treatment.Instead,a system for the collaborative management of emerging contaminants and environmental risk control suitable for China's national conditions must be constructed.The key to establishing such a system lies in legislation.In this regard,the Chinese ac‐ademic community has generally provided three legislative and regulatory pathways:the specialized legislative model,the decentralized regulation model of environmental single-line laws,and the codification model.Compared to the first two legislative options,the codifi‐cation model is the most appropriate choice that is in line with the current development status of environmental rule of law in China.Therefore,in the context of the Ecological and Environmental Code being put on the legislative agenda,it is advisable to take this oppor‐tunity to make comprehensive provisions and systematic arrangements for emerging contaminant management during the compilation of the code.In the future,the management of emerging contaminants in China should be guided by the value orientation of safeguarding ecological security and public health,fundamentally adhering to a holistic systemic view,utilizing collaborative management as the ba‐sic approach,and focusing on environmental risk management as the core content.Accordingly,based on the legislative demand for"moderate codification,"China should establish the precautionary principle within the ecological environment code to highlight the val‐ue of safety,dedicate a specific chapter to'emerging contaminant management and risk control'to address practical needs,and extend relevant concepts and systems to this field to achieve systemic coherence.
