监管实践视角下宠物医疗纠纷治理困境与破局路径OA

The balance between dispute governance system and pace of industrial development is increasingly distorted under the context of accelerated expansion of pet economy and vigorous development of pet medical industry.Here,starting from a case regarding a pet medical dispute in a district of Shenzhen,key contradictions currently faced in the governance of pet medical disputes were thoroughly analyzed,including conflicts between traditional property right positioning of pets and the emotional value claimed by their owners;dilemmas of liability determination arising from gaps in professional standards and limitations in investigative authority for fact-finding;fragmentation of administrative regulatory authority and insufficient supply of resources;monotonization of dispute resolution mechanisms;lag in the regulatory system of veterinary drugs for pets relative to industry development;and other systemic challenges.Based on regulatory practices,analysis on typical cases and advanced domestic and international governance experiences,targeted recommendations were proposed,including establishing common standards for fact determination,improving diversified dispute resolution mechanisms,optimizing the allocation of regulatory authority,and refining management system for veterinary drugs,aiming to construct a new pattern of pet medical regulation where industrial development was harmonious with the protection of rights and interests.
