体育纠纷解决机制的二维结构与规则完善OA

The newly revised Sports Law has transformed the sports dispute resolution mechanism into a two-dimensional cross-cutting structure,i.e.,horizontal with the content of the dispute as the axis and vertical with the means of redress as the axis.However,the horizontal dispute content lacks the category of sports administrative disputes,and there is a cross-cutting dilemma with the sports ar-bitration system.The study concluded that the formation of sports administrative legal relationship makes sports administrative disputes fall within the scope of sports arbitration as stipulated in Article 92 of the new Sports Law.However,due to the contractual,au-tonomous and professional characteristics of sports arbitration,sports administrative dispute resolution in sports arbitration may be alienated,and there is a potential risk of shaking the neutrality,impartiality and credibility of sports arbitration.Therefore,it should first clarify the priority status and neutrality of the sports arbitration system compared with the litigation procedure,and divide the sports administrative disputes into the disputes of the administrative departments of the State Council and the administrative subjects of other sports administrative organs in accordance with the administrative organs,so as to set up a systematic arrangement for the relator to connect with the administrative litigation or the direct administrative litigation.
