帮助信息网络犯罪活动罪行刑反向衔接的困境检讨与因应对策OA
Dilemma Review and Countermeasures of Reverse Connection Between Crime and Punishment in the Crime of Assisting Information Network Criminal Activities
帮信罪行刑反向衔接,不仅是为了顺应宽严相济刑事政策而构建梯度化处遇机制的基本要求,更是化解帮信罪"口袋罪"风险的应有之义.然而,帮信罪适用行刑反向衔接的司法实践依然暴露出诸多困境,尤其表现在罪名审查标准模糊、程序衔接受阻以及运行机制滞后等方面.基于此,当前应细化帮信罪适用行刑反向衔接的审查要素,重点围绕客观帮助行为、明知范围以及情节严重认定标准3个方面予以限缩解释,并丰富审查"入行"的考量因素.另外,还应形塑帮信罪适用行刑反向衔接的机制,确立证据转化区分审查模式,健全统一办案平台与协同执法机制,同时依托数字检察提升反向衔接的工作质效.
The reverse connection mechanism between crime and punishment in the crime of assisting information network criminal activities not only constitutes a fundamental requirement for establishing tiered punishment systems aligned with the balanced criminal justice policy,but also serves as an essential measure to mitigate the"catch-all"risks inherent in such offenses.However,judicial practices applying this mechanism still reveal multiple challenges,particularly evident in ambiguous charge review standards,deficiencies in procedural coordination mechanisms,and outdated application methodologies.To address these issues,current efforts should focus on refining review criteria for such reverse connections in the crime of assisting information network criminal activities.This requires restrictive interpretation centered on three key aspects:objective acts of assistance,scope of knowledge,and severity determinations,while expanding consideration factors regarding"entry into operations".Additionally,establishing a coordinated connection mechanism involves implementing differentiated evidence conversion review models,improving unified case-handling platforms and collaborative enforcement frameworks,and leveraging digital prosecution systems to enhance the efficiency of reverse enforcement processes.
