The Constitutional Foundations of the Codification of Labor Law in China

宪法是影响劳动法典编纂进程的关键因素.劳动法的法典化是否存在宪法动因,能够在何种层面上获得宪法的支持,宪法中的哪些规范可以为劳动法的法典化提供基础,这些问题均有必要进行深入探讨.就当前而言,处于单行立法状态的中国劳动法体系在形式和内容上均存在缺陷,致使其行宪能力受到严重制约,需要借助法典化过程予以完善.在此前提下,宪法还能够为劳动法的法典化过程提供方法指引.详言之,劳动法可以通过宪法探寻法典化的价值目标、为法典文本的编纂寻求技术支持,并获得对本领域疑难问题的权威注解.最后,现行《宪法》中与劳动相关的基本权利条款、国家目标条款、国家义务条款以及基本义务条款均可在不同程度和维度上为劳动法的法典化提供规范基础.

The Constitution is a key factor influencing the codification process of labor law.Hence,it is necessary to explore in depth whether there are constitutional motivations for the codification of labor law,to what extent it can receive constitutional support,and which norms within the Constitution can provide a foundation for such codification.Currently,China's labor law system,which exists in the form of separate legislation,has deficiencies in both form and content,severely constraining its ability to implement the Constitution.These shortcomings need to be addressed through the codification process.Under this premise,the Constitution can also provide methodological guidance for the codification of labor law.Specifically,labor law can utilize the Constitution to examine the value objectives of codification,seek technical support for compiling the code's text,and obtain authoritative interpretations for difficult issues within its field.In addition,the fundamental rights clauses,state objective clauses,state obligation clauses,and basic duty clauses related to labor in the current Constitution can provide normative foundations for the codification of labor law to varying degrees and from different dimensions.
