基于BBNJ协定的中国远洋渔业发展路径探讨OA

《<联合国海洋法公约>下国家管辖范围以外区域海洋生物多样性的养护和可持续利用协定》(英文简称 BBNJ 协定)的达成标志着全球海洋生物多样性治理进入新阶段,对作为远洋渔业大国的中国提出了新的要求和挑战.本文基于该协定的制度安排及我国远洋渔业产业现状,分析协定生效可能对我国远洋渔业带来的发展机遇与挑战,并系统提出我国远洋渔业的未来发展路径:积极参与公海海洋保护区制度、完善远洋渔业环境影响评价制度、加强能力建设与渔业科技合作以及深化远洋渔业绿色转型与国际合规等.通过上述举措,我国可在维护国家海洋权益和水产品供给安全的同时,更好地履行国际义务,促进公海生物多样性养护与可持续利用,推动远洋渔业高质量转型发展,为全球海洋治理贡献中国力量.

The conclusion of the BBNJ Agreement marks a new phase in global marine biodiversity governance,presenting both new requirements and challenges for China as a major distant-water fishing nation.Building on the Agreement's institutional arrangements and China's distant-water fisheries industry status,this article analyzes the opportunities and challenges of its entry into force on China's distant-water fisheries.In light of the industry's current status,the paper systematically proposes development pathways for China's distant-water fisheries.These include proactively responding to the high seas marine protected area mechanism,improving environmental impact assessment mechanisms for high seas fisheries,enhancing capacity building and technical cooperation,and advancing the green and sustainable transformation and international compliance of distant-water fisheries.Through these measures,China can safeguard its national maritime rights and seafood supply security while better fulfilling international obligations,promoting the conservation of high seas biodiversity,achieving high-quality and transformative development of its distant-water fisheries,and contributing Chinese expertise and capacity to global ocean governance.
