Risk types and hierarchical governance of e-CNY smart contracts
数字人民币智能合约借助算法化的执行机制,实现了对传统金融契约履行方式的重要革新.其技术应用在拓展数币功能的同时,也会伴生出不同的过渡性风险样态:代码漏洞与系统性能的技术风险、算法刚性与规则弹性之间的匹配问题、跨层域传导中的衔接需求转变.为应对上述伴随性的可控风险,亟需构建技术验证、法律衔接与系统韧性相协同的治理框架,通过安全沙盒测试提升合约可靠性,推动法律规则向可执行代码参数转化,并在运营环节设置风险熔断与隔离机制,从而在支持智能合约创新与维护金融系统稳定之间实现动态平衡.
The e-CNY smart contract reconstructs the fulfillment paradigm of traditional financial contracts through an algorithmic execution mechanism.Its hierarchical deployment architecture forms unique risk types while expanding the functions of currency.Technically,it exhibits inherent defects such as code vulnerabilities and system performance issues.In terms of business,it reflects the value conflict between rigid algorithms and legal flexibility.Systematically,it generates complex vulnerabilities due to cross-layer conduction and cross-domain interaction.The risk generation mechanism is rooted in the inherent contradiction between code logic and financial laws,manifest-ing as multiple dilemmas such as the essential conflict between technical logic and legal logic,the multiplier effect of system complexity and risk conduction,and the normative gap between legal lag and technological advancement.Therefore,it is necessary to construct a collaborative framework that integrates technical verification,legal adapta-tion,and system isolation.This framework ensures contract security through sandbox testing mechanisms,converts legal rules into executable code parameters,and sets up a risk-off mechanism at the operational level.Ultimately,it aims to achieve a dynamic balance between the innovative potential of smart contracts and the stability of the finan-cial system within the e-CNY application system.
