人格矫治目标下罪错未成年人分级处遇标准的优化OA
Optimization of Graded Intervention Standards for Juvenile Delinquents under the Objective of Personality Rehabilitation
人格矫治强调通过心理干预、认知重建等维度修复罪错未成年人的内在人格偏差.对罪错未成年人的分级处遇应以人格矫治为根本目标,而现行以行为为标准的罪错未成年人分级处遇制度存在结构性缺陷:分级处遇标准过度依赖行为后果,忽视人格特质差异;处遇措施未能结合个体要素制定个性化方案.为此,应以"行为危害+人格特质"为分级处遇标准;依据行为危害性对罪错未成年人进行初步分流后,通过心理学量表等工具考量人格特质,同时配套构建科学的罪错未成年人人身危险性评估体系,最终制定差异化矫治方案.
Personality rehabilitation emphasizes repairing intrinsic personality deviations in minors through psy-chological interventions and cognitive restructuring.The graded intervention system for juvenile delinquents should fundamentally aim at personality rehabilitation,yet current behavior-based frameworks exhibit struc-tural deficiencies:overreliance on behavioral consequences while neglecting personality trait variations,and failure to develop personalized intervention protocols incorporating individual factors.To address these issues,this study proposes a dual-criterion framework integrating"behavioral harmfulness+personality traits".Fol-lowing preliminary categorization by behavioral severity,psychological assessment tools should evaluate per-sonality characteristics,accompanied by establishing a scientific risk assessment framework for minors.This approach ultimately facilitates differentiated rehabilitation plans tailored to individual needs.
